K. L. Kris Food Industries Sdn. Bhd. is a manufacturer and processor of high-quality cocoa ingredients, including Alkalized Cocoa Powder, Natural Cocoa Powder, Cocoa Liquor / Mass, and Cocoa Butter. We supply these products to clients in the food, beverage, confectionery, and industrial sectors globally.

Our Group of Companies includes K. L. Kris Cocoa Manufacturer (M) Bhd., K. L. Kris Consolidated Holding Sdn. Bhd., Rathika Spice Industries Sdn. Bhd., Victoria International Sdn. Bhd., Crestonia Management Sdn. Bhd., and Rathika Flour Mills. References to “Krisfood” in these Terms extend to the Group where context requires.

By using this Site you represent and warrant that:

• You are at least 18 years of age, or the age of legal majority in your jurisdiction.
• If you are acting on behalf of a company or organisation, you have the authority to bind that entity to these Terms.
• Your use of the Site does not violate any applicable law or regulation.

The “Krisfood” name, logo, and all related product names, designs, and slogans are trademarks or registered trademarks of K. L. Kris Food Industries Sdn. Bhd. and its affiliates. You may not use any of these marks without our prior written permission.

You may print or download content from the Site for your own personal or internal business reference only, provided you:

You agree to indemnify, defend, and hold harmless Krisfood and its Group of Companies, officers, directors, employees, contractors, agents, licensors, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Our Privacy Policy explains how we collect, use, and protect personal data in compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia and applicable international data protection laws.

Krisfood shall not be liable for any failure or delay in performance of its obligations under these Terms or any related agreement to the extent such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, fire, war, civil unrest, government action, labour disputes, or failures of third-party telecommunications or infrastructure.

We reserve the right to revise and update these Terms at any time at our sole discretion. All changes are effective immediately upon posting to the Site. Your continued use of the Site after any revisions constitutes your acceptance of the updated Terms. We recommend that you review this page periodically.

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Malaysia.

The courts of Malaysia (and specifically the courts of the State of Selangor and/or the High Court of Malaya in Kuala Lumpur) shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter, except where mandatory consumer protection rules in another jurisdiction apply.

For users located within the European Union: Nothing in these Terms affects your rights as a consumer under EU law, including the right to bring proceedings in the courts of your country of residence.

In the event of any dispute arising from or in connection with these Terms, the parties shall first attempt to resolve the matter through good-faith negotiations for a period of at least thirty (30) days from the date one party notifies the other in writing.

If the dispute cannot be resolved through negotiation, the parties may refer the matter to mediation under the rules of the Malaysian Mediation Centre before commencing legal proceedings.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any applicable commercial agreements, constitute the entire agreement between you and Krisfood with respect to the subject matter herein, and supersede all prior communications, representations, or agreements, whether oral or written.
